These Terms & Conditions ("Terms", "we", "us", "our") govern your use of the AI HabitMind iOS application ("App") developed and provided by Yuliia Kulakova ("Developer", "I").

These Terms form a binding legal agreement between you and the Developer. By downloading, installing, or using AI HabitMind, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Acceptance of Terms

By using AI HabitMind, you accept these Terms in their entirety.

• If you do not agree to any part of these Terms, you may not use the App
• Your use of the App signifies acceptance of these Terms
• Continued use of the App after changes to these Terms constitutes acceptance
• If you do not accept these Terms, delete the App immediately

3. License Grant

We grant you a limited, non-exclusive, non-transferable license to:

• Download and install the App on your personal iOS devices
• Use the App for personal, non-commercial habit tracking purposes
• Access features according to your subscription tier (Free, Smart, or Pro)

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove copyright or proprietary notices
• Use the App for commercial purposes without permission
• Distribute, rent, lease, or lend the App
• Use the App to develop competing products
• Access the App's code or attempt to bypass restrictions

4. Subscription Terms

5. Auto-Renewal & Billing

5.1 Auto-Renewal Terms

• Both Smart and Pro subscriptions are auto-renewing
• Your subscription will automatically renew unless cancelled before the renewal date
• Your credit card will be charged via Apple automatically on the renewal date
• You will receive a reminder from Apple 24 hours before the charge
• If renewal fails, the App will prompt you to update payment information

5.2 How to Cancel Subscription

You can cancel your subscription at any time using one of these methods:

1. Through iOS Settings:
   • Open Settings app on your iPhone
   • Tap your Apple ID profile (top of screen)
   • Select "Subscriptions"
   • Find "AI HabitMind"
   • Tap "Cancel Subscription"
2. Through App Store:
   • Open App Store app
   • Tap profile icon (top-right)
   • Select "Subscriptions"
   • Find "AI HabitMind"
   • Tap "Cancel Subscription"

Important: Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the period ends.

5.3 Billing Information

• All billing is processed through Apple's App Store
• We do NOT have access to your payment card information
• Apple handles all payment processing and security
• You may update payment information through your Apple ID settings
• Failed payments may result in access restrictions until resolved

6. Payment & Refund Policy

6.1 Subscription Refunds

Refund requests are subject to Apple's standard refund policy.

• Most subscriptions may be refunded if requested within 14 days of purchase
• Requests made after 14 days are typically denied per Apple policy
• To request a refund: Contact Apple at reportaproblem.apple.com
• We cannot process refunds directly - only Apple can issue them

6.2 Unused Portions

• Refunds for unused portions of a subscription are typically not available
• Cancelling mid-cycle will not result in a pro-rata refund
• You retain access until the end of your current billing period after cancellation

7. User Responsibilities

You agree to:

• Comply with Laws: Use the App only for lawful purposes in compliance with all applicable laws
• Account Security: Maintain the security of your Apple ID and device
• Device Security: You are responsible for all activity on your device
• Acceptable Use: Not use the App to:
  • Hack, exploit, or abuse the App or other users
  • Transmit malware or harmful code
  • Harass, threaten, or defame others
  • Violate intellectual property rights
  • Circumvent security or access controls
  • Use for illegal activities or fraud
• Device Requirements: Ensure your iOS device meets minimum requirements

8. Data Ownership

8.1 Your Data

• Your habit data belongs to you. You retain all ownership rights.
• We grant you a license to use our App to create and store your data
• You own all content you create: habits, entries, notes, mood ratings
• We may not use your data for any purpose other than providing the App

8.2 App Ownership

• All AI HabitMind code, design, and features remain our property
• You do not own, license, or have rights to the App's intellectual property
• You cannot claim ownership or derivative rights to the App

8.3 Feedback & Suggestions

• Any feedback, suggestions, or ideas you provide may be used by us to improve the App
• You grant us a license to use your feedback without compensation
• We are not obligated to implement or acknowledge your suggestions

9. AI Disclaimers

9.1 Not Medical or Professional Advice

• AI HabitMind is NOT:
  • Medical advice or diagnosis
  • Psychological treatment or therapy
  • Professional coaching or counseling
  • A substitute for professional help
• If you have mental health or medical concerns, consult a licensed professional
• AI predictions and recommendations are informational only

9.2 AI Predictions Not Guaranteed

• AI failure predictions are probabilistic estimates, not certainties
• Predicted failures may not occur, and unpredicted failures may happen
• Recommendations are based on your data patterns but are not guaranteed to work
• Individual results vary based on personal circumstances and external factors

9.3 Limitations of AI Analysis

• AI analysis is based only on data you provide
• Limited external data may result in less accurate predictions
• AI does not have information about your life circumstances, health, or external pressures
• AI cannot account for unexpected life events or major changes

9.4 Your Responsibility

• You are solely responsible for your habits and health decisions
• You are solely responsible for the accuracy of data you input
• You must use your own judgment in adopting recommendations
• Do not rely solely on AI recommendations for important decisions

10. Limitation of Liability

10.1 No Warranties

• We provide the App "AS IS" without warranties of any kind
• We do NOT warrant that the App will be error-free or uninterrupted
• We do NOT warrant that AI predictions or recommendations will be accurate
• We do NOT warrant that using the App will improve your habits
• We assume no responsibility for failures to complete habits

10.2 Limited Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for any loss of data, profits, or opportunities
• We are not liable for any habit failures or missed goals
• We are not liable for any health issues or misuse of health data
• We are not liable for disruptions or unavailability of the App
• We are not liable for any reliance on AI recommendations
• Our total liability shall not exceed the amount you paid us in the past 12 months

10.3 Risk Assumption

You assume all risks associated with:

• Using the App
• Relying on AI recommendations
• Your habit success or failure
• Any decisions made based on AI analysis

11. Intellectual Property

11.1 App Ownership

• AI HabitMind, including all code, design, and features, is our exclusive property
• The app is protected by copyright, trademark, and intellectual property laws
• You may not claim ownership or derivative rights
• All rights not expressly granted are reserved

11.2 Third-Party Components

• The App uses Apple frameworks (SwiftUI, CloudKit, HealthKit, StoreKit 2)
• Use is governed by Apple's terms and conditions
• You comply with Apple's terms by using the App

12. Termination

12.1 Termination of License

Your license to use the App may be terminated if you:

• Violate these Terms
• Use the App for illegal purposes
• Attempt to hack, exploit, or abuse the App
• Repeatedly violate our acceptable use policy

12.2 Effect of Termination

• Upon termination, your license to use the App immediately ceases
• You must stop all use of the App
• Data deletion may occur per our Privacy Policy
• Paid subscriptions may be cancelled with no refund

13. Modifications to Terms

• We may modify these Terms at any time for any reason
• Material changes will be announced in the App or App Store
• Updated terms take effect when posted
• Continued use after changes constitutes acceptance
• We will update the "Last updated" date at the top of this document

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with applicable law, and any disputes shall be resolved according to the laws in the jurisdiction where the developer is located.

14.2 Arbitration

• You and the Developer agree that any disputes shall be resolved through binding arbitration
• Arbitration is faster and less formal than court proceedings
• You waive your right to a jury trial
• Each party bears its own legal costs unless otherwise ordered

14.3 Limitation Period

• Any claim must be filed within 1 year of the incident
• Claims filed after 1 year are barred
• This limitation applies to all types of claims

15. Governing Law

These Terms are governed by the laws applicable to the jurisdiction where the Developer is located. Any legal action or proceeding arising under these Terms shall be subject to:

• Exclusive jurisdiction of courts in that jurisdiction
• Applicable laws in that jurisdiction
• Consumer protection laws (where applicable)
