These Terms of Use ("Terms") govern your use of the Nanela iOS application ("Nanela", "the App") developed by Yuliia Kulakova ("the Developer"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
Nanela is not a medical device and does not give medical advice.
Nanela is a private record of your pregnancy and of your baby's first year. It does not diagnose, monitor or treat any condition in you or your baby, it gives no verdicts, and it is not a substitute for antenatal, midwifery or medical care.
Nanela deliberately does not tell you what to do. It sets no thresholds, raises no alarms and does not decide when something is or is not normal — because that judgement depends on you, on your pregnancy and on the guidance where you live.
If anything worries you, contact your midwife, your doctor or your maternity unit — at any hour, and however many times. In an emergency call your local emergency number. Do not rely on the App.
The Developer grants you a personal, non-exclusive, non-transferable, revocable license to use Nanela on Apple devices you own or control, in accordance with these Terms, the App Store Terms of Service and Apple's Licensed Application End User License Agreement.
You may not copy, modify, reverse engineer, decompile, resell, sublicense or redistribute the App or any part of it, except where such restriction is prohibited by applicable law.
Nanela is free to download. Without a subscription you can set up your pregnancy, read the week-by-week pages, and use the whole App to look at what is there.
A subscription unlocks saving your own records — movements, weight, blood pressure, how you feel, medicines, appointments, notes, and everything in the baby section: feeds, sleep, nappies, growth and first foods — together with the page you take to an appointment.
It is offered as an auto-renewing subscription:
The exact price for your country and currency is shown in the App Store and inside the App before you confirm anything. Prices may differ by region and may change; any change applies only to future billing periods and you will be informed as required by Apple.
A free trial may be offered before the first paid period. Where a trial is offered:
All purchases are processed by Apple. The Developer does not receive or store your payment details.
Purchases are sold by Apple, and refunds are handled exclusively by Apple under its policies. The Developer cannot issue refunds. To request one, visit reportaproblem.apple.com. Statutory withdrawal or refund rights available to you under your local law are not affected.
Some pages quote guidance published by public health services and name the source. Nanela does not write medical content of its own, does not interpret that guidance for your case, and does not adapt it to your history.
Guidance differs between countries and changes over time. What is quoted may not match the practice where you live or the advice your own clinician has given you. Where they differ, follow your clinician.
Nanela shows and organises what you enter. Dates, weeks and totals are worked out from the values you provide — an inaccurate due date or a mistyped entry produces an inaccurate result, and you are responsible for checking your records, particularly before showing them to a clinician.
Ways of counting weeks differ by country and by clinic. Nanela lets you choose one; if it does not match what your clinician uses, the number shown will not match theirs.
Reminders are scheduled and delivered by iOS. Their delivery depends on your notification settings, on Focus modes and on the state of your device, and cannot be guaranteed. Do not rely on Nanela as the only reminder for an appointment or a medicine.
Your records are stored on your device and, only if you turn sync on, in your own private iCloud. The Developer has no access to them and therefore cannot recover them. You are responsible for your own backups. Deleting the App, resetting your device or turning off iCloud may result in permanent loss of your records. See the Privacy Policy.
You agree to use Nanela for lawful, personal, non-commercial purposes, not to attempt to circumvent purchase mechanisms, and not to interfere with the App's operation.
Nanela, its name, design, artwork and source code are the property of the Developer and are protected by copyright and other laws. What you write — your dates, your records, your notes — remains entirely yours.
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. The Developer does not warrant that the App will be uninterrupted or error-free, or that reminders will always be delivered on time. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of or inability to use the App — including any decision made or delayed regarding your health, your pregnancy or your baby's care. To the extent liability cannot be excluded, it is limited to the amount you actually paid for the App in the twelve months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded by law.
These Terms apply for as long as you use the App. You may terminate them at any time by deleting the App. The Developer may suspend or terminate the license if you materially breach these Terms. Sections that by their nature should survive termination (including 7–13) will survive.
These Terms may be updated from time to time. The current version is always published at this address with its "Last updated" date. Continuing to use the App after an update constitutes acceptance of the revised Terms.
