Velvie — Terms of Use

These Terms of Use ("Terms") govern your use of the Velvie iOS application ("Velvie", "the App") developed by Yuliia Kulakova ("the Developer"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.

Velvie is a tool for keeping your own book — not accounting, tax or legal advice.

Velvie is a private appointment book and client book for a beauty professional. The totals it shows — what came in, what is your own after materials and fixed costs — are worked out from the figures you enter, for your own overview. They are not a substitute for an accountant, and they do not calculate or file your taxes.

You remain responsible for your own bookkeeping, tax and legal obligations, and for the personal data of the clients you keep in the App (see section 9).

1. License

The Developer grants you a personal, non-exclusive, non-transferable, revocable license to use Velvie on Apple devices you own or control, in accordance with these Terms, the App Store Terms of Service and Apple's Licensed Application End User License Agreement.

You may not copy, modify, reverse engineer, decompile, resell, sublicense or redistribute the App or any part of it, except where such restriction is prohibited by applicable law.

2. What is free

Velvie is free to download. Without a subscription you can set up your studio, add services and prices, and fill things in to see how the whole App works.

Saving your records is what a subscription is for. You can try any screen and enter a visit or a client to see how it feels; keeping those records — so your book fills up over time — requires an active subscription.

3. Subscription

A subscription unlocks saving your own records — your clients, your appointments and visits, treatment cards and photos, and your money.

The exact price for your country and currency is shown in the App Store and inside the App before you confirm anything. Prices may differ by region and may change; any change applies only to future billing periods and you will be informed as required by Apple.

5. Payments, renewals and cancellation

All purchases are processed by Apple. The Developer does not receive or store your payment details.

6. Refunds

Purchases are sold by Apple, and refunds are handled exclusively by Apple under its policies. The Developer cannot issue refunds. To request one, visit reportaproblem.apple.com. Statutory withdrawal or refund rights available to you under your local law are not affected.

7. Your money figures

Velvie shows and organises what you enter. Earnings, materials, your take-home and other totals are worked out from the values you provide — a mistyped price or a missed visit produces an inaccurate total, and you are responsible for checking your own figures. Amounts are shown in the currency you set and are not converted between currencies. Velvie is a private overview, not an accounting system of record.

8. Accuracy and reminders

Dates, totals and free-time slots are worked out from what you enter; an inaccurate entry produces an inaccurate result. Reminders are scheduled and delivered by iOS. Their delivery depends on your notification settings, on Focus modes and on the state of your device, and cannot be guaranteed. Do not rely on Velvie as the only reminder for an appointment.

9. Your clients' data

Velvie lets you keep details about your clients — a name, and, if you add them, a phone number, a birthday, a note, and photos of your work. For that information, on your device, you are the data controller and Velvie is the tool you use. You are responsible for having a lawful basis to keep it and, where your local law (such as the GDPR) requires, for informing your clients and honouring their requests. The Developer never receives this information and cannot access it. See the Privacy Policy.

10. Your data and backups

Your records are stored on your device and, while sync is on, in your own private iCloud. The Developer has no access to them and therefore cannot recover them. You are responsible for your own backups — Velvie lets you export a backup file with your records and photos. Deleting the App, resetting your device or turning off iCloud may result in permanent loss of your records.

11. Acceptable use

You agree to use Velvie for lawful purposes, not to attempt to circumvent purchase mechanisms, and not to interfere with the App's operation.

12. Intellectual property

Velvie, its name, design, artwork and source code are the property of the Developer and are protected by copyright and other laws. What you write — your clients, your prices, your notes and photos — remains entirely yours.

13. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. The Developer does not warrant that the App will be uninterrupted or error-free, or that reminders will always be delivered on time. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of or inability to use the App — including any lost booking, missed reminder or business decision. To the extent liability cannot be excluded, it is limited to the amount you actually paid for the App in the twelve months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded by law.

15. Termination

These Terms apply for as long as you use the App. You may terminate them at any time by deleting the App. The Developer may suspend or terminate the license if you materially breach these Terms. Sections that by their nature should survive termination (including 7–14) will survive.

16. Changes to these Terms

These Terms may be updated from time to time. The current version is always published at this address with its "Last updated" date. Continuing to use the App after an update constitutes acceptance of the revised Terms.
